The people at Portfolio Recovery are genuine bottom feeders of debt collection industry. They buy old statute expired debt and through harassment tactics try to collect 10 to 30 cents on the dollar. Of course the minute anything is collected, the statute date resets to day 1 and their other outfits and ambulance chasers come after you. If you have noticed their letter of settlement is only for the debt with them, not original debtor or the next place they sell it to. The only way to fight these guys is to get with your state authorities. These guys know all the Federal loopholes.

They are trying to collect on an old credit card debt from over 6 years ago. The statute of limitations in Pennsylvania is 4 years on credit card debt. The SOL varies by state (check yours) This company deals in old debt. DO NOT PAY THEM ANYTHING OR ADMIT YOU OWE ANYTHING TO ANYONE. If you pay them anything it resets the Statute of Limitations to ZERO and allows them to collect the debt. Something else to check for your state is "can wages be garnished for credit card debt?". In Pennsylvania wages CAN"T BE GARNISHED FOR CREDIT CARD DEBT. I have done a great deal of online research on "statute of limitations" debts. Hopefully this will help someone else. If you receive another call or letter from this company. EXPLAIN YOU ARE "DISPUTING THE DEBT" and THAT YOU WANT TO "VERIFY" IT. Portfolio Recover must reply by law. The info they supply will state when and where to debt occurred. WHEN is very important. They can sue you for recovery ( garnishment ). The debt collector must notify you in writing if it plans to sue you. A Statute of Limitations defense is an "affirmative" defense - meaning you must reply to their suit and inform the judge of your defense. These are also called "time-barred" debts The verification letter you receive is proof acceptable in court. If you are sued they can't try to take any property (car, home & etc.) Credit card, medical bills and some others are "Unsecured Debt". Check your debt type online. You may need to request "Verification of your Debt" in a letter. A Google search will produce samples of these letters. If you need their address see below. Forgot to say if your debt has been on your credit report for several years THEN PAYING THE DEBT WILL NOT IMPROVE YOUR CREDIT SCORE. I got a free credit report (no credit card needed) at CREDITKARMA.COM my debt was listed but no dates on the debt were listed except when RECOVERY ASSOCIATES purchased my debt (for pennies on the dollar). THE DATES I NEED ARE NOT ON MY CREDIT REPORT.
